General Terms and Conditions of Delivery

Article 2 – Applicability
2.1 These terms and conditions apply to all offers, contracts and deliveries by Bikeshop Texel. (Hereinafter: “the seller”, “we” or “us”).
2.2 By “consumer” we mean: any natural person acting for purposes outside their business or professional activities. (Hereinafter: “consumer”, ”you” or “your”).
2.3 These terms and conditions apply to any agreement between you and us relating to products and/or services.
Article 3 – Formation of the contract
3.1 A contract is formed once we have confirmed your online order electronically or once we have received the signed confirmation form.
3.2 We will confirm receipt of your online order by email without delay.
3.3 Any additional agreements or amendments shall only be binding if we have confirmed them in writing.
Article 4 – Prices
4.1 All prices are in euros and include VAT.
4.2 Any delivery charges will be clearly stated during the ordering process before the contract is concluded.
4.3 Quotations are valid for the period specified therein. If no period is specified, they are valid for 14 calendar days, subject to availability.
Article 5 – Payment
5.1 When making a purchase at our shop, payment must be made immediately at the till using a payment method accepted by us.
5.2 When purchasing via our website, payment must be made prior to delivery.
5.3 All products supplied remain our property until all amounts due have been paid in full.
5.4 Payment must be made in euros, unless otherwise agreed in writing.
Article 6 – Delivery
6.1 We take the utmost care when processing orders.
6.2 If a product is in stock, we will contact you to arrange a delivery time.
6.3 Delivery will be made to the address you have provided. You are responsible for ensuring that this address is correct and complete.
6.4 We remain liable for any damage to or loss of the product until it has been delivered to you or to a third party designated by you.
6.5 Delivery charges may vary depending on the product and will be communicated in advance.
6.6 We deliver exclusively within the Netherlands, with the exception of the Frisian Wadden Islands and areas where legal or regulatory restrictions (such as environmental zones or zero-emission zones) apply to our delivery vehicles.
Article 7 – Right of withdrawal
7.1 When purchasing products via the website, you have the right to cancel the contract within 14 days of receipt without giving any reason.
7.2 For services, a 14-day cooling-off period applies from the date the contract is concluded.
7.3 The right of withdrawal lapses if you have expressly requested that the service be performed in full within the cooling-off period and have thereby declared that you waive your right of withdrawal once the contract has been fully performed.
7.4 You are responsible for the cost of returning products, unless we have stated otherwise in advance.
Article 8 – Obligations during the cooling-off period
8.1 You must handle the product and its packaging with care.
8.2 You are liable for any loss in value if the product has been used beyond what is necessary to establish its nature, characteristics and functioning.
Article 9 – Exercising the right of withdrawal
9.1 Cancellation may be made by email, telephone or by means of another unambiguous statement within the cooling-off period.
9.2 The product must be returned or handed in within 14 days of cancellation at the latest.
9.3 Returns must be made with all accessories and in their original condition, as far as reasonably possible.
9.4 You bear the risk of return shipment until we have received the goods.
9.5 A collection appointment can be arranged by mutual agreement for the return of bicycles.
9.6 The burden of proof regarding timely cancellation lies with you.
Article 10 – Refunds
10.1 We will refund all amounts received within 14 days of cancellation, including standard delivery charges. Any return costs will, however, be charged.
10.2 Refunds will be made using the same payment method, unless otherwise agreed.
10.3 We may deduct a depreciation charge if the product has been damaged or used carelessly.
Article 11 – Conformity and warranty
11.1 We guarantee that the products comply with the terms of the contract and the statutory conformity requirements.
11.2 New bikes and products are covered by the standard manufacturer’s warranty, which you can read about on the websites of the various brands. Second-hand bikes are covered by a dealer’s warranty of 0 to 3 months (frame, motor and battery); this varies depending on the bike.
11.3 The warranty shall lapse if defects are the result of improper use, maintenance, repairs carried out by third parties, or normal wear and tear.
11.4 If a product is covered by the warranty, we will repair or replace it.
11.5 If repair or replacement is not possible, you are entitled to terminate the contract.
11.6 This warranty does not affect your statutory rights regarding conformity.
Article 12 – Privacy
12.1 Our policy on the processing of personal data is privacy policy as applicable, as published on our website.
Article 13 – Final provisions
13.1 Any deviations from these terms and conditions are only valid if agreed in writing.
13.2 We may amend these terms and conditions and will give at least one month’s notice of any changes via our website.
13.3 These terms and conditions are governed by Dutch law.
13.4 Disputes may be brought before the competent court in the Netherlands or via the European Commission’s ODR platform.
